Bivens Action Unsealed: Greenlaw, et. al., including United Development Funding IV v. Klimek, Bunch, Edson (E.D. Tx. April 13, 2020)

United Development Funding, L.P., United Development Funding III, L.P., United Development Funding IV, United Development Funding Income Fund V, United Development Funding Land Opportunity Fund, L.P., certain UDF executives and entities have filed a civil Bivens Complaint against FBI Agents Christy Edson and David Klimek and Assistant United States Attorney Nicholas Bunch. A Bivens action is a direct civil lawsuit against federal employees which alleges tortious violations of specific constitutional rights. Damages arising from this tort and punitive damages can be recouped in a successful Bivens action. In this instance, the Bivens Complaint is temporarily under seal and we have moved to unseal it. The Motion to Unseal the Complaint and the Declaration of Paul E. Pelletier, however, are not under seal and they generally set forth the factual basis for the allegations of constitutional violations which give rise to the Complaint. When the Complaint is unsealed by the Court and available to the public it will be posted to this site.
